Smoke Creek Ranch is providing Member with a directory web site to list Member's web site(s). Smoke Creek Ranch provides free ads and pay ads and Member agrees to pay amounts payable for ads selected by Member. Member must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Member's access to the Internet, and (3) pay any fees relate with such connection.

2. Disclaimer of Warranties.
SMOKE CREEK RANCH MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO ANY PRODUCT OR THE RELATED DOCUMENTATION AND TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, THE SITE IS DELIVERED "AS IS." 5. Member Account
Members are entirely responsible for any and all activities which occur within their account whether authorized or not authorized. Member agrees to notify Smoke Creek Ranch of any unauthorized use of Member's account or any other breach of security that is known or should be known to the Member. Member's right to use the Service is personal to the Member. Member agrees not to resell or make any commercial use of the Service without the express written consent of Smoke Creek Ranch.

6. Modifications and Interruption to Service
Smoke Creek Ranch reserves the right to modify or discontinue the Service with or without notice to the Member. Smoke Creek Ranch shall not be liable to Member or any third party should Smoke Creek Ranch exercise its right to modify or discontinue the Service. Member acknowledges and accepts that Smoke Creek Ranch does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

a.You may not under any circumstances list a Listing in connection with any illegal, obscene, immoral, or pornographic material.

b. All Listings must be related to horses, farm and ranch and cowboy western.

15. Hit Counter
Hit counter display is for the convenience of the viewing public. This information is to inform the viewing public the popularity of any given web site. Abuse of the hit counter feature by any listing Member, Member's family or friends will result in your listings counter to being reset to zero. If abuse is detected for a second time your hit counter will be shut off or your listing will be removed by Smoke Creek Ranch's management.

16. Refunds

17. Submission of Content on Smoke Creek Ranch Ownership of Submitted Content: the copyrights in and to all Submitted Content remain with the owner of such copyrights. Nothing contained herein shall be construed to be a transfer of any copyrights to Smoke Creek Ranch.

Reviews are not places to handle any disputes you may have with any listing Members. If you are having or have any problems with a listing Members listing, web site or business practices take that problem up with the listing Member. If your account is terminated for any such violation, you lose all rights to use Smoke Creek Ranch services, and Smoke Creek Ranch management may IMMEDIATELY delete any and all listings, and you forfeit all fees paid.

20. Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by Smoke Creek Ranch, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
